Smith Brandenburg Ltd.: Mr. Smith is the founding member of Smith Brandenburg Ltd. and started the practice in 1995. He concentrates his practice in the areas of high technology law including the acquisition, auditing, licensing and enforcement of intellectual property rights, with particular emphasis on patent, trademark, and trade secret matters; business strategies; and the formation of high technology ventures. He has drafted and prosecuted numerous patent applications relating to materials, chemical compositions, software, bio-technology, software, scanning systems, mechanical and electrical devices. His experience includes negotiating and preparing license agreements, joint development and joint venture agreements, patentability, infringement and validity opinions, and agreements and strategies for the protection of confidential and trade secret information. Mr. Smith has experience in civil litigation in both state and federal courts, including federal litigation involving “cutting-edge” issues involving trademark use and the Internet and was lead counsel for the plaintiff in trade secret litigation resulting in a 8.3 million dollar judgment (and attorney fees). He also has experience in business litigation, mergers and acquisitions, including corporate acquisitions, corporate compliance matters, and general corporate law matters.

Prior Legal Experience:

Patent Counsel and Assistant General Counsel for Essex Group, Inc.:

Prior to joining the firm, Mr. Smith was Patent Counsel and Assistant General Counsel for Essex International, a FORTUNE 500 wire and cable manufacturer, and was responsible for the company’s entire intellectual property portfolio. In addition, he was responsible for providing legal support for export control, corporate acquisitions (including business acquisitions in the U.SA. and Mexico), environmental (Super Fund) responses, litigation (products liability, antitrust and contract), contract negotiations, corporate contracts (intellectual property licensing, joint venture, university, independent contractor, sales and marketing representation agreements) and corporate compliance programs.

Practiced intellectual property law prosecuting trademark and patent applications for a variety of electrical/mechanical technologies.

Attorney for The General electric Company, Cincinnati, Ohio:

Prosecuting patent applications relating to aircraft engine technology.

Engineering Experience:

General Electric Company, engineer working in the areas of aero-thermal computer modeling, high temperature turbine design and product development and with the National Aeronautics and Space Administration (N.A.S.A.) in the fields of aero-acoustics and unsteady aerodynamics.

Education: B.S. degree in Aerospace Engineering from the University of Cincinnati and a J.D. degree from Salmon P. Chase College of Law, Northern Kentucky University.

Adjunct professor at the University of Cincinnati teaching courses in Technology Law and Intellectual Property. Listed in Who’s Who In American Law. Licensed to practice before the U.S. Patent and Trademark Office, the courts of the State of Ohio, and in the United States District Court, Southern District of Ohio.
